From Notice of Detention to Christmas with the Family

We have assisted a national of Albania who was served with a Notice of Detention following a Notice of Intention to Deport him.  We argued that his deportation from the United Kingdom was in no way imminent, and despite representations to the Home Office, he had not been released. We challenged the position of the Secretary of State not to release him after his Conditional Release Date, and represented him in Court, reminding the Court of the bail guidance for Judges.  (Presidential Guidance Note No. 1 of 2012) which in essence directs a First Tier Tribunal Judge to grant bail where there is no sufficiency or good reason to detain a person, and a lesser measure can provide adequate alternative means of control”.   The case was heard days before Christmas and our client spent Christmas with his family.
